JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2017 The petitioner is in custody since 21.10.2016 in connection with Kachhwan P.S. Case No. 27 of 2016, registered for offences punishable under Sections 341, 323, 504, 307, 506, 379, 354/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that only general and omnibus allegation of assault on informant and his wife has been made against this petitioner, however all the injuries are found to be simple in nature except one injury on the informant and one other injury on the person of the wife of the informant, but the said injuries are not on the vital part of their body and the petitioner has been in judicial custody for about 4 and half months.
Patna High Court Cr.Misc. No.4269 of 2017 (2) dt.14-02-2017 2/3 Heard learned A.P.P. and learned counsel for the informant, they have opposed the prayer for bail. Having heard both sides, though several injuries were inflicted on the person of the informant and his wife, however most of the injuries were found to be simple in nature except two injuries one inflicted on the person of the informant and other inflicted on the person of the wife of informant, which appears to be grievous but they are also not found on the vital part of their body, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, in connection with Kachhwan P.S. Case No. 27 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and
