ANSHUMAN ORAL ORDER 13-01-2023 Heard learned counsel for the petitioner, counsel for the State and counsel for the AG through virtual mode. Learned counsel for the petitioner submits that he has filed the present writ petition seeking direction from this Court for pension, gratuity, G.P.F. and other retiral dues along with Revised Pay Scale of 7th Pay Commission with 18% interest per annum, to be paid to the petitioner.

Learned counsel for the petitioner submits that during pendency of writ petition, State served a counter affidavit, by which it transpires to him that a pension adjustment of Rs.

Patna High Court CWJC No.15197 of 2021(2) dt.13-01-2023 2/2 23,73,300 /- has been directed to be made from petitioner's retiral dues.

He submits that, petitioner has received the said order during pendency of the case by virtue of receiving the counter affidavit. There are limitation in filing appeal, so liberty is hereby granted to the petitioner to prevail appeal against the order described in Memo No. 911 dated 01.06.2021 passed by District Magistrate, Gaya against the petitioner. Respondent is directed to calculate entire dues of the petitioner and admissible dues may be paid within 8 weeks from today.

With this direction, this Writ petition is hereby disposed off with liberty granted to prefer appeal. (Dr. Anshuman, J.) ashishsingh/- U
