Petitioners apprehend their arrest in a case under section 366, 498 and other sections of the I.P.C. The informant alleged that Bhola Yadav, son of petitioner no.1, kidnapped her married daughter. When the informant went to enquire, the petitioner no.1 being uncle of Bhola Yadav, abused her.

It appears that there is no allegation of kidnapping against the petitioners. The victim herself, in her statement under section 164 Cr.P.C, has stated that the petitioners kidnapped her. It is submitted that the victim was recovered, while moving along with Bhola Yadav but the petitioners were present in their houses and victim after being tutured made statement under section 164 Cr.P.C. naming the petitioners. Considering the facts aforesaid, the petitioners, in the event of their arrest/surrender before the court below within four weeks from the date of receipt/production of a copy of this order,

Patna High Court Cr.Misc. No.41017 of 2014 (2) dt.02-04-2015 are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna in connection with Naubatpur P.S.Case No.389 of 2013, subject to condition laid down u/s 438(2) Cr.P.C.
