JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Buxar (Muffasil) P.S. Case No. 51 of 2019 registered for the offence punishable under Section 394 of the Indian Penal Code.

There is allegation of committing robbery in the house of the informant and petitioner is not named in the FIR and his name transpired in the confessional statement of co-accused and further it appears that petitioner is accused in one more case of similar type.

Submission of learned counsel for the petitioner is that description of accused persons has been given in the FIR as the persons between age group of 20-25 years but petitioner is aged 45 years and except confessional statement there is nothing

Patna High Court CR. MISC. No.36428 of 2019(3) dt.14-08-2019 2/2 against him.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner in confessional statement petitioner has been named and he has criminal antecedent also. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
