The petitioner is apprehending his arrest in connection with Sadar P.S. Case No.567 of 2013 for the offences instituted under Sections 376, 120 (B) of the I.P.C. and Section 3⁄4 of the Scheduled Castes and Scheduled Tribes ( prevention of atrocities) Act.
The prosecution story, in brief, is that when the informant Sita Devi who happens to be the maid in the house of the petitioner, was cleaning the house the petitioner and the mother of the petitioner who is a school teacher had gone to the School, Gulab Bagh, the petitioner bolted the room and forcibly
Patna High Court Cr.Misc. No.41871 of 2014 (6) dt.04-09-2015 2/3 committed rape upon the victim. The petitioner threatened her not to disclose it to anyone and he went on perpetuating this act on false assurance of marriage the victim became pregnant.The coaccused including petitioner got the victim aborted. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been falsely implicated in the present case. Petitioner denies the allegation of any physical relationship with the informant. It has further been pointed out that the matter has been settled between the parties.
On behalf of the State and the informant it has been submitted that the matter has already been resolved between the parties.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Sadar (Purnea) P.S. Case No.567/13 of 2013 corresponding to G.R. No.4364/13 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, subject to the conditions as laid down
