Case No. 285 of 2014 for the offence under Sections 147, 148, 149, 323, 325, 307, 447, 448, 452, 353, 186, 427, 435, 436, 109, 224, 225, 440, 120B of the Indian Penal Code and 52 of the Prisoners Act.

The prosecution story, in brief, is that when the prisoner Santosh Jha and Madhav Chaudhary were transferring to another jail, their supporters created nuisance in the jail campus and started throwing bricks and stones upon the informant and officers and injured them, broke the gate of campus, set the hospital and stores room on fire. It is submitted on behalf of the petitioners that at the time of incident the petitioners were in judicial custody in connection with some other case. Subsequently, after their release on bail in connection with the respective cases they were subsequently remanded in the present case. It is further submitted that as per the prosecution, omnibus and general allegation has been made against them. No specific overt act has been attributed against the petitioners.
On behalf of the State, it has been submitted that the petitioners are named in the First Information Report. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.
