JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Darbhanga Town P.S. Case No. 181 of 2016 instituted for the offence under Sections 363 and 366(A) of the Indian Penal Code.

It has been submitted that statement of victim girls has been recorded under section 164 Cr.P.C. wherein they have stated that they were in love with the petitioner and co-accused Deepak Kumar.

Case diary was called for wherein statement of victim girls is mentioned at paras- 68-69(wrongly mentioned as para-68 in the case diary in place of 69). At para 68, victim Puja Kumari stated that she was in love with the petitioner and she wanted to marry with him while the other victim girl, Anjali Kumari has

Patna High Court Cr.Misc. No.7890 of 2017 (3) dt.20-03-2017 2/2 stated that she was in love with co-accused Deepak with whom, she wanted to marry.

It has been mentioned that other accused with similar allegation has been granted regular bail by a coordinate Bench of this Court vide order dated 14.2.2017 passed in Cr. Misc. No. 1565 of 2017.

Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Town P.S. Case No. 181 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
