JUSTICE SATYAVRAT VERMA ORAL ORDER 01-02-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with Barachatti P.S. Case No. 722 of 2020 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are in custody since 01.03.2021, are persons with clean antecedent and charge-sheet has been submitted in this case.

The informant alleges that his daughter (deceased) was married with Santosh Das in 2020. After marriage accused persons were demanding Rs.50,000/- as dowry, further in 2021 a

Patna High Court CR. MISC. No.50400 of 2021(2) dt.01-02-2022 2/2 daughter was born. It is next alleged that due to non-fulfillment of the dowry demand, the deceased was killed by her husband and in-laws by pouring kerosene oil.

Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased. The husband of the deceased is in custody and the allegation with regard to these petitioners is concerned, the same has been made only to falsely implicate them as the informant is not an eyewitness of the occurrence.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent, charge-sheet has been submitted and the husband of the deceased is in custody, let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S.
