JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 302/34 of the Indian Penal Code.
It is alleged that the son of the informant took `1 lac from Pramod Mishra subsequently the son of the informant issued a cheque which got bounced then the petitioners went reconcile the issue between the parties, in the meantime, co-accused Pramod Mishra pushed the husband of the informant as a result the husband of the informant received injury on the forehead subsequently he succumbed the injuries.
Patna High Court Cr.Misc. No.14784 of 2015 (2) dt.15-04-2015 2/2 It is submitted by learned counsel for the petitioners that the accusation of overt act is not alleged against the petitioners. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Sadar P.S. Case No. 149 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
