The petitioner has prayed for bail in connection with Kochas P.S. Case No. 178 of 2018 for the offence punishable under section 379 of the Indian Penal Code.

As per the allegation in the FIR, it is alleged by the informant that on the date of occurrence he parked his motorcycle at Semariya Plant and when he returned after about 30 minutes he found his motorcycle missing.

It is submitted by learned counsel for the petitioner that so far as the petitioner is concerned, his name has transpired on the confessional statement of the co-accused Mantu Ram. No incriminating article was recovered from his possession. The stolen motorcycle was recovered from the house of the coaccused Mantu Ram and the petitioner is in custody since

Having heard learned counsel for the petitioner and learned APP for the State and taking into consideration the fact that the name of the petitioner has transpired on the confessional statement of the co-accused Mantu Ram and that no incriminating article was recovered from his possession, the Court is inclined to enlarge the petitioner on bail. The petitioner named above is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Rohtas, Sasaram in Kochas P.S. Case No. 178 of 2018.
