This application has been filed in connection with Sonepur P.S.ae No.421 of 2016 for the offence under Sections 25(1-B)A, 26 and 35 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the only allegation against the petitioner is about recovery of one Pistol and one cartridge. He is in custody for about five months. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, the learned court below is directed to verify the criminal antecedent of the petitioner and if he is satisfied that the petitioner has no criminal antecedent, he will release the petitioner on bail bond of Rs.25,000/- (Twenty Five

Patna High Court Cr.Misc. No.11688 of 2017 (4) dt.06-04-2017 2/2 Thousand) with two sureties of the like amount on the further condition hat he will co-operate in trial and on failure to attend on two consecutive dates, the learned court below may cancel his bail bond and if any criminal antecedent is found against the petitioner, he will report the matter to this Court.
