JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 The petitioner is apprehending his arrest in connection with Nanpur P.S. Case No. 255 of 2014 for the offences instituted under Sections 498(A)/34 of the Indian Penal Code and 3⁄4 of the D. P. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the informant was married with this petitioner on 07.12.2013 according to Muslim Rites and Customs. She went to her Sasural and lived happily for some days. Thereafter, her husband and other accused persons, as mentioned in the written report, started assaulting the informant for demand of Rs. 2 lacs and a motorcycle. They also gave threat to perform second marriage of husband of the informant, if the

The father of the informant and other villagers came to persuade the accused-persons, but they did not listen. It is further alleged that on 01.08.2014, all the accused persons assaulted the informant, and snatched her stridhan. The accused persons finally ousted the informant from their house. The informant came to her maike and gave information to her father. It is further alleged that the father of the informant took efforts to settle the matter, but the accused persons did not change their behaviour.
It has been submitted on behalf of the petitioner that the petitioner has got criminal antecedent. It is further submitted that as per Muslim law the petitioner has already divorced the informant. It is further submitted that the petitioner is ready to deposit amount of Rs. 1,000/- each month in the court below which may be released in favour of the informant. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the same, the petitioner is directed to deposit amount of Rs. 1,000/- each month in the court below which shall be released in favour of the informant, let the above named, petitioner, be released on bail in the event of his arrest or surrender
Patna High Court Cr.Misc. No.20672 of 2015 (2) dt.02-07-2015 3 / 3 before the learned court below within a period of four weeks from today in connection with Nanpur P.S. Case No. 255 of 2014 (G.R. No. 832 of 2014) on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri at Sitamarhi, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
