ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 2.7.2014 in connection with Rupauli P.S. Case No.54/13 for the offence under Section 302/34 of the I.P.C. and 27 of the Arms Act. The allegation against the petitioner is that he along with one Mangal Pandit participated in the case leading to the alleged occurrence.
Learned counsel for the petitioner submits that so far as the petitioner is concerned, there is virtually no allegation against him excepting the fact that he been falsely implicated on account of previous land dispute.
Considering the aforementioned submission and also
Patna High Court Cr.Misc. No.42682 of 2014 (5) dt.03-03-2015 2/2 the fact that the petitioner is an old man of 65 year and has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Purnea, in Rupauli P.S. Case No.54/13.
