JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2017 This is an application for grant of bail for offences punishable under Section 302 of the Indian Penal Code. Petitioner is not named in the F.I.R. Later on, his name has transpired in this case on the basis of confessional statement before the police in other case which has also been attached with this case.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that except the confessional statement in other case, there is nothing against the petitioner. Furthermore, he is in custody since July, 2016.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.16786 of 2017 (3) dt.01-05-2017 2/2 Having heard both sides and the confessional statement of the petitioner before the police, I am not inclined to grant bail to the petitioner, the same is rejected. However, since the petitioner is in custody for ten months, the trial court (S.D.J.M., Mashaurhi, Patna) is directed to expedite the trial in connection with Punpun P. S. Case no. 137 of 2016 of the petitioner and conclude the same as early as possible preferably within a period of one year.
