JUSTICE ARUN KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner, already in custody, seeks bail in connection with Kadwa (Balia Belon) P.S. Case No.323 of 2016, registered under Sections 272, 273 and 414 of the Indian Penal Code as well as Section 30(A) of the Bihar Excise Act, 2016. Allegation is that from the dickey of Maruti Esteem Car, 191.28 litres of foreign liquor was recovered and the owner of the vehicle and this petitioner were apprehended. Learned counsel for the petitioner submits that the petitioner had taken the lift, the owner of the vehicle was also apprehended and he has been in custody since 30.12.2016, having no criminal antecedent.

Having considered the said facts and circumstances,

Saddam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Katihar in connection with Kadwa (Balia Belon) P.S. Case No.323 of 2016.
