JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Kiul P.S. G.R.P. Case No. 36 of 2017, registered under Sections 30(A) and 38(i) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of three bags, each containing 20 litres, of country made liquor beneath the seat of general compartment of Train No. 1313 Up (Calcutta-Patna) Express and the petitioners were found sitting on the seat. Learned counsel for the petitioner submits that petitioners have falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.13503 of 2017 (2) dt.24-03-2017 suspicion. It is further submitted that petitioners have no criminal antecedent and are in custody since 09.02.2017. Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway Court, Kiul, in connection with Kiul P.S. G.R.P. Case No. 36 of 2017. Out of two sureties, one surety must be the close relative of the petitioners.
