2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 420, 504, 506, 34 of the Indian Penal Code.

3. As per the prosecution case, allegation against the petitioner that the he along with other co-accused person took Rs. 10,70,000/- to open poultry farm from the informant but they did not return the entire amount.

4. It is submitted that petitioner was munshi of coaccused Raj Kumar and has acted as per his instruction . Coaccused, Raj Kumar has already refunded the amount of Rs. 6,50,000/- to the informant on different dates in the Court below

Patna High Court CR. MISC. No.40222 of 2022(4) dt.19-08-2023 2/2 , copy of which is annexed as P/4 contend in supplementary affidavit. Petitioner has not committed any offence and claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the facts that the alleged amount in the FIR has already been paid in the Court below and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Vaishali at Hajipur in connection with Vaishali P.S. case no 69 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
