2. The petitioner apprehends his arrest for the offences alleged under Section 498A of the Indian Penal Code registered in connection with Complaint Case No. 1650 of 2010.
3. It is submitted that the petitioner has been falsely implicated and this is the first grievance of its nature since the parties were married on 16.04.2009. It is submitted that the petitioner is ready and willing to keep the complainant with due dignity and honour who however is resisting to live with the petitioner.
4. Despite issuance of notice, opposite party no.
Patna High Court Cr.Misc. No.30707 of 2014 (3) dt.10-03-2015 2 has refused to accept which is treated as valid service. None appears on her behalf when the matter is called out.
5. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Complaint Case No. 1650 of 2010, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
