The petitioner apprehends his arrest in connection with Gwalpara P.S. Case No.07 of 2022, registered for the offence punishable under Section 394 of the Indian Penal Code. The petitioner alongwith other co-accused persons snatched Rs.15,122/-, one TAB and mobile phone from possession of the informant. The accused persons also assaulted the informant by means of butt of country made pistol. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that no incriminating article
Patna High Court CR. MISC. No.39212 of 2022(2) dt.17-11-2022 2/2 has been recovered from the conscious possession of the petitioner, which is also clear from the impugned order. It is also submitted that the specific allegation is against co-accused, Praveen Kumar.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioner by submitting that petitioner is also involve in the alleged offence.
Considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Anjani Kumar Sharan, J) Sanjay/- U T
