2. The petitioner is in custody since 21.11.2016 in connection with Araria (R.S.) P.S. Case No. 791 of 2016, G.R. No. 3898 of 2016 for the offences alleged under Section 414 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated as he had merely taken a lift on the motorcycle from an unknown person and the petitioner has no knowledge about the motorcycle.

4. Having regard to the nature of accusations, gravity of the offence alleged as well as his failure to explain the circumstances under which he is said to have been trying to sell the motorcycle, this Court is not inclined to grant the privilege of bail to the petitioner.
