Supplementary counter affidavit has been filed on behalf of the Respondent Nos. 2 to 4. However, at the time of hearing, learned counsel for the State informs this Court that the service book has already been released in favour of the Circle Officer, Dinara and the State authorities are in the position to calculate and to pay the entire admitted dues of the petitioner.

Ordered as accordingly. The authority will calculate the dues and pay with respect to different heads as has been mentioned in Para 1 and 7 of the supplementary affidavit including the 6th pay revision along with the statutory interest, if admissible, within a

Patna High Court CWJC No.6506 of 2015 dt.17-11-2016 2/2 period of three months.

If the same is not paid within a period of three months then the petitioner would be entitled for further interest of 8 percent per annum on the unpaid admitted amount. However, it does not mean that no action would be taken against the erring person as the District Magistrate has already recommended for the same. Writ application stands disposed of with the aforesaid observations and direction.
