In the nature of the order which this court proposes to pass it would not require to await filing of the counter affidavit. The petitioner substantively an employee of the Bihar State Cooperative land Development Bank Ltd., Budh Marg, Patna was appointed on contract basis by the respondent Corporation as manifest from the order bearing Memo No.144 dated 17.4.2017 of the Bank. Certain disputes arose as regarding the salary payable to the petitioner for which the petitioner came before this Court in C.W.J.C.No.5679 of 2014 and which was disposed of with liberty to the petitioner to represent before the respondent No.3. The grievance of the petitioner

Patna High Court CWJC No.13790 of 2016 dt.26-07-2017 2/2 in the present writ petition is that neither his contract was extended nor he was repatriated to his parent employer i.e. Bihar State Cooperative Land Development Bank rather was made to retire vide order bearing memo No. 2179 dated 5.7.2016. It is the contention of Mr. Sahvind Kumar Sharma that either the services of the petitioner ought to have been extended by the Corporation or his services should have been returned to his parent Bank. A representation in this regard also remains pending before the District Manager of the respondent Corporation at Bhaglapur present at Annexure-4. Although Mr.

Kumar learned counsel for the corporation prays for a short adjournment to seek instructions as according to him petitioner has not disclosed entire facts but in the nature of the grievance raised, I deem it proper to dispose of the writ petition with the direction to the District Manager, Bihar State Food and Civil Supplies Corporation, Bhagalpur to examine the grievance of the petitioner as reflecting from his representation present at Annexure-4 and dispose of the same in accordance with law within a period of 3 months from the date of receipt/production of a copy of this order.
