Petitioner is accused in connection with Siwan Rail (Thawe) P.S. Case No. 65 of 2016 registered under Section 39(a) of the Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner has no concerned with the seized liquor and nothing has been recovered from his possession. Further submission is that petitioner has no criminal antecedent and is in custody since 22.10.2016.
