2. The present application has been filed for setting aside the order dated 23.08.2018 passed by learned Sub- Judge, 1st (West) Muzarrarpur in Partition Suit No. 426 of 2010 by which the learned Sub-Judge has allowed the petition dated 08.01.2018 filed by the respondent.

3. By the impugned order, the amendment application has been allowed.

4. In view of the law laid down by the Hon'ble Supreme Court in the case of Life Insurance Corporation of India vs. Sanjeev Builders Private Limited reported in 2022

Patna High Court C.Misc. No.1794 of 2018(5) dt.10-10-2023 2/2 LiveLaw (SC) 729, I do not find any illegality in the impugned order.
