The petitioners apprehend their arrest in Piro P.S. Case no. 187/14, registered for the offences punishable under Sections 302, 120B and other Sections of the Indian Penal Code. The informant Ayodhya Singh named Prem Prakash Singh, Raju Singh, Rajesh Singh, Dhiraj Singh, Haricharan Singh, Vinay Singh, Satyendra Singh and Dhananjay Singh @ Chhotu Singh and alleged that they all made indiscriminating firing. Some how the informant, Vikash Kumar, Ram Singh and Tej Narayan Singh managed to flee away but Manoj Kumar Yadav, the second son of the informant came across in the firing and he died on the spot. The informant has named seven persons including the

Patna High Court Cr.Misc. No.41903 of 2014 (3) dt.14-05-2015 2/2 petitioner and alleged that they have conspired for killing his son. It is submitted that there is no material to show that the petitioner has conspired for killing the son of the informant. The police found the allegation of conspiracy against the accused persons false but the police did not collect any tangible evidence to show the involvement of the petitioner.

Considering the facts aforesaid and the fact that the petitioner is alleged to have conspired but the petitioner is not assailant of the deceased and the investigating officer did not collect any tangible material to show the involvement of the petitioner in conspiracy of killing of the deceased, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ara in connection with Piro P.S. Case No. 187/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
