Petitioners seek regular bail in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code and u/s 8 of POCSO Act.

As per the prosecution case, these petitioners along with other accused persons kidnapped the minor daughter of informant for the purpose of marriage.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that the victim in her statement u/s 164 of the Cr. P. C. has stated that she voluntarily left her house and

Patna High Court CR. MISC. No.49495 of 2021(2) dt.24-11-2021 2/2 solemnized marriage with Pannalal Choudhary. She stated her age 20 years. These petitioners are full brothers of Pannalal Choudhary. Petitioners claim clean antecedent and are in custody since 19.02.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the period of custody of the petitioners and the statement of victim recorded u/s 164 of the Cr. P. C., let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum- Special Judge, POCSO Act, West Champaran, Bettiah in connection with Gaunaha PS case No.08/2021.
