JUSTICE AMARESH KUMAR LAL ORAL ORDER 27-03-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code. It is submitted that the petitioner is one of the named accused. There is no allegation of assault against the petitioner and during investigation, the witnesses have also stated that the petitioner came to the place of occurrence after the occurrence. It is further submitted that the allegation of assault was against Amrendra Kumar Pandey @ Amrendra Pandey @ Tuntun Pandey, who has been granted anticipatory bail vide Cr. Misc. No.42374/2014. The petitioner has no criminal antecedent.

No.42240 of 2014 (3) dt.27-03-2015 2/2 Considering the facts and circumstances of the case, let the petitioner above-named be released on bail in the event of arrest or surrender within a period of four weeks on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in Bhagwanpur P.S. Case No.84/2014 subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure and the other following conditions : 1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
