The petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and under Section 25(1-b)a, 26 and 35 of the Arms Act and Section 20, 22, 25 and 29 of the N.D.P.S. Act. The learned Senior counsel for the petitioner submits that the present bail application has been filed in terms of the liberty granted to the petitioner by order dated 29.03.2023 in Criminal Miscellaneous No. 14068 of 2023 whereby the petitioner was granted liberty to renew his prayer for bail after framing of charge.

Patna High Court CR. MISC. No.40577 of 2023(2) dt.05-07-2023 2/2 submits that the charges against the petitioner were framed on 20.01.2023.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the submission made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Barauli P.S. Case No. 249 of 2021.
One of the bailors of the petitioner shall be his father namely Akhileswar Rai.
Further, in the event, if the learned Trial Court comes to a conclusion that petitioner after his release is trying to delay the trial in any manner, then the learned Trial Court shall be at liberty to cancel his bail bonds and to take all coercive steps to ensure that petitioner is behind bar.
