2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 272, 273 and 34 of the IPC Section 30 (A) , 37 ( B ) of the Bihar Prohibition and Excise Act.

3 . It is alleged that 140 liters of illicit liquor was recovered from the motorcycle of petitioner of which he is registered owner.

4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case only on the basis of suspicion . The seized motorcycle was used by other co-accused persons in transporting the alleged illicit liquor without knowledge and concern of this petitioner.

Patna High Court CR. MISC. No.36806 of 2025(2) dt.11-07-2025 2/2 Nothing has been recovered from the conscious possession of petitioner and has got no concern with the alleged occurrence . Charge sheet has already been submitted. Petitioner is in custody since 29.04.2025 .

5 . Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Exclusive special Judge Excise Court Saran at Chapra in connection with Chapra Muffasil P. S. Case No. 485 of 2019.
