Petitioner apprehends his arrest in Srinagar (Pujaha) P.S. Case No. 27 of 2014 registered under sections 25(1B)a, 26 of the Arms Act.
According to the prosecution case petitioner and Firoz Gaddi were apprehended by the police and from their possession arms and ammunitions were recovered but the petitioner managed to flee away. It is submitted that petitioner was not apprehended and nothing has been recovered from his possession. Petitioner has no criminal antecedent. Having considered the fact that from the possession of the petitioner arms and ammunitions were recovered
Patna High Court Cr.Misc. No.40959 of 2014 (3) dt.01-04-2015 2/2 and petitioner managed to flee away from the custody of the police, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly the same is dismissed.
