JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 461/379 of the Indian Penal Code.

Some unknown person committed theft in the shop of the informant.

Submission of the petitioner is that nothing has been recovered from the possession of the petitioner nor the petitioner has got any criminal antecedent. He is in custody since 21.11.2016 but he has not been put on Test Identification Parade. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.13337 of 2017 (2) dt.22-03-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani/Successor Court, in connection with Madhubani Town P.S. Case No.364 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
