JUSTICE SANJAY PRIYA ORAL ORDER 2/ 03-07-2019 This application has been filed for modification of the order dated 13.10.2017 passed in Cr. Misc. No.44944 of 2017 by which petitioners were granted anticipatory bail in connection with Bhaptiyahi P.S. Case no.56 of 2017 to the satisfaction of the Chief Judicial Magistrate, Supaul. Counsel for the petitioners submits that they could not surrender within time. The counsel for the petitioners makes prayer for extension of time to surrender in the Court below. It appears that petitioners have not surrendered in the Court below for about two years after grant of anticipatory bail by this Court.

This Court does not find sufficient ground to extend

This Modification Application is, accordingly, dismissed.

The petitioners are directed to surrender in the Court below and make prayer for regular bail which shall be considered and disposed off by the Court below, in accordance with law, preferably, on the same day, without being prejudiced by this order.
