The petitioner is in custody in connection with Udwantnagar P.S. Case No. 162 of 2019, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case total 46.500 liters foreign liquor was recovered. He further submits that nothing has been recovered from the conscious physical possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody in this case since 01.05.2019.

Patna High Court CR. MISC. No.35510 of 2019(2) dt.30-05-2019 2/2 Considering the fact that petitioner has no criminal antecedent, the Court is inclined to release the petitioner on bail. Let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 4th Additional Sessions Judge-cum Special Judge, Excise, Act Bhojpur (Arra) in connection with Udantnagar P.S. Case No. 162 of 2019.
