ANJANA PRAKASH ORAL ORDER 20-02-2015 The petitioner seeks quashing of the order dated 07.02.2011 passed by the Presiding Officer, Special Court PESU II, Patna in Gandhi Maidan P.S. Case No. 542 of 2010. It has been submitted on behalf of the petitioner that he has paid around 13 lacs to the Electricity Department and therefore this prosecution should be set aside. However, on query as to whether he has paid the compounding fee, he submits that he has filed an application before the authority concerned but they have not passed any order as yet.

In such circumstance the authority concerned is directed to pass final order on the application of the petitioner with regard to compounding within a period of six weeks from the date of receipt of this order, thereafter the petitioner shall pay the amount

Patna High Court Cr.Misc. No.21189 of 2012 (6) dt.20-02-2015 2/2 and approach the Trial Court with a certificate in its regard after which the proceeding shall stand dropped.

With these observations the application stands disposed of.
