Petitioner is in custody since March, 2019 in a case registered for the offence under sections 302/34 and other allied sections of the Indian Penal Code on the allegation of giving knife blow on the neck of the victim.

Learned counsel for the petitioner submits that the charge sheet has been submitted and the petitioner has not been charge sheeted. However, cognizance of the offence punishable under sections 342, 323, 379, 504 & 302/34 of the Indian Penal Code has been taken against four accused persons including the petitioner.

Report of the Chief Judicial Magistrate, Gopalganj dated 6.9.2019 is on record.

Petitioner appears to be the assailant of the deceased, as such, his prayer for bail is rejected.
