The petitioner is in custody in connection with Khutauna P.S.Case No.66 of 2016 registered for an offence under Sections 401, 413 and 414 of the IPC.
The informant happens to be the police officer who in his self statement has alleged that on 22nd October, 2016 they apprehended three persons, who seeing the police party started fleeing away leaving two motorcycles on the spot. Learned counsel for the petitioner submits that apprehended accused Sanjeev Kumar @ Sanjeev Kumar Sah @ Narayan Ji Sah @ Narayan Jee has been allowed bail on 02.03.2017 in Cr.Misc.No.4858 of 2017 and another co-accused Shashi Bhushan Kumar @ Shashi Bhushan Mandal has been
Patna High Court Cr.Misc. No.11757 of 2017 (2) dt.15-03-2017 allowed bail by the court below. The case of the petitioner stands on similar footing.
Learned APP opposed the submissions.
Considering the nature of allegation, facts and circumstances as stated above, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Devesh Kumar, Judicial Magistrate, Ist Class, Jhanjharpur, Madhubani in connection with Khutauna P.S.Case No.66 of 2016.
