2. The petitioner seeks bail in connection with Rajapakar P.S. Case No. 373 of 2024 registered for the offences under Section 309(4) of the Bharatiya Nyaya Sanhita.

3. The petitioner is named in the F.I.R. and is in custody since 13.12.2024.

As per FIR, four unknown miscreants looted cash of Rs. 9,500/- from informant and also assaulted him by using butt of pistol causing injury on his tooth and upper lip, where during the occurrence petitioner was identified by one of the security personnel who was the part of team of the informant.

Learned counsel appearing on behalf of the petitioner submitted that named person who identified this petitioner not appears disclosed from the perusal of the FIR, rather it is submitted that one person who was part of the said team identified this petitioner by his name. It is submitted that no incriminating material recovered from the possession of this petitioner, which may suggest his involvement with the present crime in question.

No.39708 of 2025(4) dt.25-11-2025 2/2 While concluding the argument it is submitted that, petitioner found involved in six more cases, where he is on bail in five cases and acquitted from one case and in most of the cases his name transpired out of suspicion as of the present case and moreover, investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie name of this petitioner appears out of disclosure of unknown persons who said to be part of the team of the informant, coupled with the fact as petitioner remains in custody since 13.12.2024, accordingly above named petitioner, is directed to be released on bail in connection with Rajapakar P.S. Case No. 373 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Vaishali at Hajipur/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
