BAJANTHRI) 07-04-2023 In the instant petition, petitioner has prayed for the following relief:- "That this is an application for issuance of a writ in the nature of certiorari to quash the order as contained in memo no. 7779 dated 27.06.2016 issued under the signature of Engineer-in-Chief, Rural Works Department, Government of Bihar, Patna, whereby and where under the petitioner has been declared defaulter

Patna High Court CWJC No.22368 of 2018(3) dt.07-04-2023 2/2 and debarred from participation in further tender with immediate effect and further for issuance of any other appropriate writ/writs, order/orders it may deem fit and proper."

In the counter affidavit respondents have redressed the petitioner grievance. Para 5 (viii) reads as under:- "That it is humbly submitted that the R.W.D. Department vide its reason order no. 1050 dated 31.01.2019 removed the name of the petitioner from the debar list and the Executive Engineer, RWD Works Division Mahua has been informed vide letter no. 1195."

In the light of these facts and circumstances and the fact that petitioner has already executed the concerned work, the present petition do not survive for consideration. Accordingly, the present petition stands disposed of. (P. B. Bajanthri, J) ( Arun Kumar Jha, J) abhishekkr/- U
