The petitioner seeks regular bail in connection with Case No. C/7-376 of 2016 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation against this petitioner is that he was apprehended by the Excise Inspector and 17 bottles of foreign liquor was recovered from his vehicle.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated by the police. There is absolutely no recovery from his conscious possession and there is no antecedent against this petitioner. The petitioner is in
Patna High Court Cr.Misc. No.5845 of 2017 (2) dt.08-02-2017 2/2 custody since 12.12.2016.
Learned APP for the State opposed the submission. Considering the nature of allegation and the facts and circumstances stated above, the prayer for bail application is allowed. The petitioner, Munna Kumar Singh, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with case No. C/7-376 of 2016.
