JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-11-2019 On 15.11.2019 despite the fact that no one appeared for the petitioner, this Court granted adjournment to enable the petitioner to file a rejoinder.
Today, when the case is called out, it is found that the rejoinder has not been filed. A prayer for adjournment has been made stating that learned counsel has gone to attend a marriage ceremony.
Since despite showing indulgence on the last date no rejoinder has been filed and at this stage after going through the records this Court finds from Annexure 'R/3' to the counter affidavit that the petitioner had himself accepted the fact the land offered by him does not meet the eligibility criteria as per
Patna High Court CWJC No.21512 of 2018(4) dt.22-11-2019 2/2 the terms and conditions and further that having tried his best he was unable to provide any alternate suitable piece of land for the location, this Court finds no reason to proceed further with the matter and the prayer of the petitioner to quash the communication dated 03.10.2018 as contained in Annexure '8' to the writ application cannot be accepted.
The writ application has no merit, it is dismissed accordingly.
