BEFORE THE LOK ADALAT HELD AT HIGH COURT PATNA CWJC No. 9058 of 2016 Petitioner :Brahmdeo Rai Respondent :The State of Bihar & Ors Present:- Member(Judicial) :Mr. Justice Rajeev Ranjan Prasad Member(Legal Profession) : Mr. Amish Kumar, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: Learned counsel for the State, learned counsel for the Patna Municipal Corporation are present. Sri Akhileshwar Prasad Singh, Additional Municipal Commissioner, Patna Municipal Corporation is also present. Learned counsel for the Patna Municipal Corporation with reference to paragraph 8 of the counter affidavit filed on behalf of respondent nos. 2 and 3 submits that some of the post retiral dues of the petitioner has already been paid. The Municipal Corporation has undertaken to pay rest of the post retiral dues as per his turn without indiscrimination.

Learned counsel for the petitioner apprehends that there may be inordinate delay and discrimination in payment. Therefore, he submits that if the Patna Municipal Corporation abide by the affidavit and makes payment of the retiral dues strictly as per turn without any discrimination, the petitioner is ready to settle the dispute right now and the writ application may be disposed of in terms of the undertaking which is being given by learned counsel for the Patna Municipal Corporation in presence of the Additional Municipal Commissioner. The Additional Municipal Commissioner undertakes and agrees that he will ensure payment of the retiral dues of the petitioner as per turn without any discrimination.

The matter is being disposed of as agreed between the parties. The parties are informed that the court fee, if any, paid by any of them shall be refunded.
