The petitioner apprehends his arrest in K.Nagar(Maranga) P.S. Case No.159 of 2017 registered under Section 392 of the Indian Penal Code.

The informant alleged that while he was returning to his house he saw a red colour two wheelers parked by the side of the road. Four persons came in front of the informant and pushed the informant. The informant fell down on the ground and all the accused persons snatched his mobile, identity card, spectacles and other articles. The informant disclosed the registration number of the motorcycle by which the accused persons fled away. The informant also claimed to identify all the accused persons.

No.36404 of 2020(2) dt.09-04-2021 2/2 The learned counsel for the petitioner submits that save and except the confession of the co-accused, there is no material against the petitioner but it appears from perusal of the order of the learned Additional Sessions Judge that C.D.R. of the mobile numbers were obtained and it transpired that Dharmendra Kumar and Manish Kumar were present at the place of occurrence. Manish Kumar disclosed the name of the petitioner who was present there and committed the offence of robbery. The looted motorcycle was handed over to the petitioner which was kept in the house of Sonu Kumar. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
