JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-04-2023 The present writ petition has been filed seeking the following reliefs:- "1(A). For issuance of appropriate writ/order on direction quashing the notice dated 08.6.2022 in Encroachment Case No. 02/2022-23 by the respondent no. 6 the Anchal Adhikari Kesariya by which the petitioner has been directed to appear before him at 11.30 am. on 27.6.2022 to Show cause as to why encroachment be not removed from the land under Thana no. 250 plot No. 485 and 497 situated in village- Tajpur Patkhaulia, P.S. Kesariya District East Champaran as contained in Annexure-1 to this writ application.

(B). For issuance of appropriate writ /order on

Patna High Court CWJC No.10214 of 2022(2) dt.28-04-2023 2/2 direction Commanding the respondents to interfere in peaceful possession of the petitioner on the above mentioned land on which the petitioner has been living/residing with his family from the life time of their forefathers.

(C). For issuance of appropriate writ/order or direction commanding the respondents to allow the petitioner to live/reside on the land in question on which the petitioner has been living by constructing a house and in case he is removed to make alternate arrangement to live/reside the petitioner as he is very poor and landless person belonging to extremely backward category."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent authorities for redressal of his aforesaid grievances. Liberty, so sought, is granted.
