The petitioner seeks pre-arrest bail in connection with Ghorasahan (Lakhaura) P.S. Case No. 338 of 2014 registered for the offences punishable under sections 420, 406 and 504 of the Indian Penal Code.
It is contended that from plain reading of the FIR it would be clear that it is accused Uttam Kumar, who allegedly took friendly loan from the informant and did not return the same. Further when the informant demanded the money, accused Uttam Kumar handed over three cheques of Punjab National Bank and when presented before the Bank, the cheques were returned due to insufficient fund.
Patna High Court Cr.Misc. No.18140 of 2015 (3) dt.08-09-2015 2/2 Learned counsel for the State has opposed the prayer for bail.
Regard being had to the nature of allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in connection with Ghorasahan (Lakhaura) P.S. Case No. 338 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
