This application for regular bail arises out of Phulwariya P.S. Case No. 124 of 2020, disclosing offence punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned Senior Counsel appearing on behalf of the petitioner, referring to the First Information Report, has submitted that even as per the case of the prosecution, the illicit liquor(180 litres) was recovered from a car which was parked in front of the doorway of co-accused Bulet Kumar Prasad, who was apprehended at the spot. On the disclosure having been made by the said Bulet Kumar Prasad, the petitioner has been made accused and subsequently arrested. Referring to
Patna High Court CR. MISC. No.36231 of 2020(3) dt.20-02-2021 2/2 Annexure-2 of this application he has submitted that the said coaccused Bulet Kumar Prasad has been allowed regular bail by this Court by an order dated 09.09.2020, passed in Cr. Misc. No. 23114 of 2020.
Considering the circumstance that co-accused Bulet Kumar Prasad has been allowed regular bail by this Court, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Excise, Gopalganj, in Phulwariya P.S. Case No. 124 of 2020.
