1. The petitioner was appointed as Primary Teacher in the year 1994 and was subsequently promoted as Trained Science Teacher and presently he is Headmaster of Upgraded Middle School, Chhota Kasimchak in Danapur Block. He has been diagnosed with cancer and is under treatment at Christian Medical College, Vellore. The petitioner submitted his

Patna High Court CWJC No.9576 of 2025(3) dt.15-07-2025 2/3 representation for his transfer in any school under the Danapur Nagar Parishad area on the ground of his illness in view of policy decision dated 07.10.2024. As per the policy decision a Committee constituted by the Education Department for transfer considered the request / option of the petitioner and transferred him to Middle School, Gandhi Nagar under Danapur Nagar Parishad area. When the petitioner went to join in the transferred school i.e. Middle School, Gandhi Nagar under Danapur Nagar Parishad area, he was told that there was no vacancy of Headmaster at the said school. Therefafter the petitioner submitted his representation before the Director, Primary Education for modification of his transfer order from Middle School, Gandhi Nagar to Middle School, Lal Kothi, Danpur or Cantt. Middle School, Alakh Ward, Danapur as in both these schools the vacancy of Headmaster is there and both are situated in Danapur Nagar Parishad area.

2. Learned counsel for the State submits that the representation of the petitioner can be decided by the Director, Primary Education as per the policy decision.

3. Having considered the nature of prayer made in the writ application and the fact that representation of the petitioner is pending before the Director, Primary Education; the present writ
