The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

Prosecution case, in short, is that on 14.03.2019 the informant parked his motorcycle at Vijay Service Petrol Pump and he along with his Sala gone to take tea and after ten minutes they came back at the Petrol Pump and found that his motorcycle was not available there and was stolen from there. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.03.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Stolen motorcycle is alleged to have been

Patna High Court CR. MISC. No.36325 of 2019(3) dt.01-07-2019 2/2 recovered from the petitioner. The petitioner had no knowledge that the motorcycle in question is stolen property. Except for this, there is no other substantive evidence to suggest his implication in the present case.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Piro P.S. case No.80 of 2019.
