BAJANTHRI) 23-09-2024 On 09.08.2024, we had passed the following order : "Respondent-Managing Director, BIADA is hereby directed to take a decision on the appellant's grievance in light of representation dated 19.06.2014 produced as Annexure-1 passed in CWJC No. 10357 of 2016 while passing a detailed speaking order to the extent whether appellant is entitled to any benefits of contributory provident fund in terms of statutory rules called Bihar Contributory Provident Fund Rules, 1948 or not. He is also hereby requested to peruse the complete service records of the appellant in order to ascertain with regard to contributory provident fund made or demanded from time to time till his attaining the age of superannuation and retired from service on 31.01.2014, for the purpose of calculation, if any."

2. Resultantly, the concerned respondent has proceeded to pass order on 02.09.2024 which has been furnished along with supplementary counter affidavit as Annexure-R/7.

3. In the light of aforementioned development, the

Patna High Court L.P.A No.1497 of 2018(10) dt.23-09-2024 3/3 present L.P.A. do not survive for consideration.

4. Be that as it may, appellant is permitted to assail the order dated 02.09.2024 in accordance with law, if so advised.
