JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Learned counsel for the petitioners submits that petitioner no. 3, namely, Raja Hussain, was arrested by the police and the application with regard to petitioner no. 3, was dismissed as withdrawn vide dated 14.10.2014.

The petitioners are accused in connection with Majhauliya P.S. Case No. 131 of 2014 registered under Sections 448, 341, 324, 376, 511, 380 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that specific allegation of attempt to commit rape is against Naushad

Patna High Court Cr.Misc. No.41792 of 2014 (3) dt.04-03-2015 Alam with further allegation that both petitioner nos. 1 and 2 along with Raja Hussain carried Naushad Alam from the place of occurrence.

Having considered the facts and circumstances of the case, let petitioner nos. 1 and 2, namely, Anisha Khatoon and Gulabi Khatoon be released on bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhauliya P.S. Case No. 131 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
