The petitioner seeks bail in Sheohar P.S. Case No. 152 of 2014, registered for the offences punishable under 387 of the Indian Penal Code.
The informant alleged that from mobile no.
7563003251 he received a call and the caller demanded extortion of Rs. 5 lakhs.
Learned counsel for the petitioner submits that during course of investigation name of Pankaj Patel, Amit Kumar @ Happy Singh and others surfaced. The mobile was duly used by Pankaj Patel and the same was in actual use of Amit Kumar @ Happy Singh. The petitioner has got no manner of concern with the aforesaid mobile. Patna High Court Cr.Misc. No.12619 of 2017 (2) dt.11-04-2017 2/2 has already been enlarged on bail vide order passed in Cr. Misc. No. 17563 of 2016 on 28.04.2016. Amit Kumar @ Happy Singh has also been granted bail by the court below. The petitioner is in jail since 25.06.2015 and he has remained in jail for about one year and nine months.
Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in Sheohar P.S. Case No. 152 of 2014.
